Terms and conditions
Last updated
These terms are an agreement between you and Ekatva Projects (“we”, “us”), Ahmedabad, Gujarat, India, which operates NiyamX. By creating an account or using the service you accept them. If you use NiyamX for an organisation, you confirm you are allowed to accept them on its behalf. A signed agreement with your organisation takes precedence over these terms where the two differ.
1The service
NiyamX checks store drawings against brand standards. It reads DXF and PDF drawings, measures layouts, drafts rules from guideline documents and approved drawings, judges drawings against those rules, and supports a submission and review workflow. We may change, add or remove features over time, and will tell you in advance if a change takes away something your plan relies on.
2Findings are an aid, not an approval
NiyamX uses AI and automated measurement, and it can be wrong: it may misread a drawing, miss equipment, or misjudge a rule. Findings, scores, seating options, capacity results and reports are there to help your team review drawings faster. They are not an architectural, engineering, fire-safety, food-safety or legal opinion, and they do not certify that a store meets any law, building code or licence condition. Qualified people on your side remain responsible for checking drawings before anything is built or ordered.
3Accounts and organisations
- You must be at least 18 and give accurate details. Keep your password private; you are responsible for what happens under your account.
- An account belongs to one organisation. Your organisation’s admin controls roles and which stores you can see, and can remove you.
- Tell us straight away at the address below if you think your account has been misused.
4Plans, points and payment
- Plans and prices are listed on our pricing page. Prices are in Indian rupees and exclude GST, which is added where it applies.
- Paid AI steps spend your organisation’s points. A step is charged when it starts and refunded automatically if it fails.
- Pilot points are given once. Business points are refilled monthly and unused monthly points lapse at the next refill. Purchased top-up points do not lapse while the account is active.
- Points have no cash value, cannot be transferred between organisations, and are not refundable except where the law requires.
- Business fees are billed in advance for the term chosen. If an invoice is unpaid 15 days after it is due, we may pause paid steps until it is settled.
- Enterprise pricing, hosting, service levels and support are set out in a separate agreement.
5Your content
Drawings, standards, rules, comments and other material your organisation puts into the service stay yours. You give us permission to store, copy, process and display that content, and to send it to our service providers, only as needed to run the service for you. Generated findings and reports belong to your organisation.
You confirm you have the right to upload what you upload, including drawings prepared by architects or consultants, and that doing so does not breach anyone else’s rights or a confidentiality obligation.
6Acceptable use
You agree not to:
- upload anything unlawful, malicious, or that you do not have the right to share;
- try to access another organisation’s data, get around role or store restrictions, or probe, scan or overload the service;
- reverse engineer the service, or use it to build a competing product;
- resell or share access with people outside your organisation without our written agreement.
7Third-party services
NiyamX relies on providers such as Supabase, Vercel and OpenAI, and can connect to services your organisation uses, such as Snowflake. Connecting your own account to NiyamX is also subject to that provider’s terms, and we are not responsible for services we do not control. How we handle data with these providers is described in our privacy policy.
8Our intellectual property
The NiyamX software, website, design, type catalogue and documentation belong to us or our licensors. These terms give you the right to use the service while your account is active; they do not transfer ownership. If you send us suggestions, we may use them without obligation to you.
9Confidentiality
We treat your organisation’s drawings, standards and store information as confidential. We access them only to run and support the service, to fix problems you report, or where the law requires it.
10Suspension and termination
You can stop using the service at any time and delete your account on your profile page. We may suspend or close an account that breaches these terms, puts the service or other users at risk, or remains unpaid, and will give notice first unless the risk is urgent. When an organisation’s use ends, it can ask us within 30 days for an export of its content; after that we delete it as described in our privacy policy.
11Disclaimers
Except as written in these terms or a signed agreement, the service is provided “as is” and “as available”. To the extent the law allows, we make no other promises, express or implied, including that the service will be uninterrupted or error-free, or that its output will be accurate or fit a particular purpose.
12Limitation of liability
To the extent the law allows, neither party is liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill, including the cost of rework, delays or equipment changes on site. Our total liability arising from the service in any 12 months is limited to the fees your organisation paid us in those 12 months, or ₹10,000 if it paid nothing. These limits do not apply to liability that cannot be limited by law.
13Indemnity
You will compensate us for reasonable losses and costs arising from a claim that content you uploaded infringes someone’s rights, or from your breach of the acceptable-use rules above.
14Changes to these terms
We may update these terms. We will change the date at the top and, for significant changes, tell signed-in users at least 15 days before they take effect. Continuing to use the service after that means you accept the new terms.
15Governing law
These terms are governed by the laws of India. The courts at Ahmedabad, Gujarat have exclusive jurisdiction over any dispute arising from them, and both parties will first try to resolve it in good faith by talking to each other.
